Arbitration and Mediation
Mitchell H. Frazen has been trained and certified as a
Chairperson/Arbitrator in the Circuit Court of Cook County
Mandatory Arbitration Program since it was organized in
1990, and has served as a panel chair or arbitrator in
over 60 civil lawsuits involving claims under $30,000
over the past five years.
Mr. Frazen was also selected
and trained as a Pro Bono Mediator in the Circuit Court
of Cook County's Volunteer Mediation Pilot Project, organized
in 1993. He is available to mediate tort cases assigned
to the project for disposition.
For insurers, in 1990 Mr. Frazen
represented International Surplus Lines Insurance Company
in the successful mediation of a $1 million coverage dispute
under a non-profit directors and officers liability policy
issued to the Des Moines Water Works, using professional
mediation services. In 1995, he represented Ætna
Casualty & Surety Company in an unsuccessful mediation
of a $4.2 million coverage dispute under a stop-loss warranty
policy covering agricultural equipment sold by Case Corporation.
