Practices

Representative Experience

  • Obtained dismissal against Plaintiff who sought leave of court to amend a complaint to add our client as a defendant after the statute of limitations expired, and argued that the “relation-back doctrine” applied; the Appellate Court agreed with our attorneys that one of the elements of the doctrine was not met, and our client was not united in interest with the original defendant.
  • Obtained pre-deposition summary judgment in Bronx County, New York, against Plaintiff who allegedly sustained injuries when she slipped on construction residue and cracked cement on a broken curb adjacent to our client’s hotel property; the Court dismissed the complaint, agreeing that, per the City’s Administrative Code, our client was not responsible for the curb.
  • Obtained summary judgment for a water utility client wherein Plaintiff, a construction worker, brought claims of New York State Labor Law statute violations and common law negligence after falling into a trench to gain access to our client’s water main and sustaining injuries that later required surgeries; the Supreme Court granted the motion, dismissing Plaintiff’s claims.
  • Obtained a defense verdict in a case seeking over $50 million in compensatory damages for massive flooding across two states allegedly caused by negligent maintenance and operation of three large dams during a severe storm; the plaintiffs’ claim for over $50 million in punitive damages was dismissed on summary judgment.
