Russell S. Massey

Russell has extensive experience representing insureds and self-insureds in all areas of civil litigation. He handles product liability, employment, and environmental litigation as well as construction defect litigation.  Russell has also represented insurance carriers in insurance coverage litigation. 

Russell has broad experience in both federal and state courts at the trial and appellate levels and has also represented clients before the Pennsylvania Humans Relations Commission, the Equal Employment Opportunity Commission, and the New Jersey Division on Civil Rights.  He has also represented clients in numerous Alternative Dispute Resolution forums.

Russell has been a frequent lecturer on a wide variety of topics, including indoor air vapor intrusion, expert witness discovery and electronic discovery. He also presented a CLE seminar in New Jersey entitled “Working out Injuries at the Gym” which addressed liability waivers at gyms. 

Russell has successfully defended a product manufacturer from personal injury and property damage claims in a large environmental matter involving the release of at least 15,000 gallons of gasoline into a residential neighborhood.  Russell also won a significant decision before the New Jersey Supreme Court in the case of Stelluti v. Casapenn Enterprises, LLC, 1 A.3d 678 (N.J. 2010), wherein the New Jersey Supreme Court upheld the use and enforceability of waiver of liability forms in the context of a gym.
