LITCHFIELD CAVO handles employment liability defense (and coverage) matters of all types. The Firm’s practice in this area has grown with the national increase in employment-related claims. For example, our experience includes:

  • Representation of employers in agency proceedings (such as EEOC, Illinois Department of Human Rights, Chicago Commission on Human Relations, United States Department of Education).
  • Representation of employers in federal and state court actions.
  • Participation in mediation, arbitration, and other forms of alternative dispute resolution.
  • Investigation of internal complaints of sexual harassment or other forms of discrimination, as well as workplace violence issues.
  • Review in-house employment manuals and practices for compliance with laws and prevention of future employment-related issues.

Our representation of employers encompasses all forms of discrimination (such as race, age, gender, disability, religion and sexual orientation) as well as claims of retaliation, defamation, intentional infliction of emotional distress, breach of employment contract, failure to pay commissions, wrongful discharge, and failure to accommodate. Some examples of our recent representations include:
  • Defense of a major insurance broker against claims of age and race discrimination and retaliation by a former employee.
  • Defense of a dental office accused of permitting a hostile environment through sexual jokes and banter.
  • Defense of police departments accused of discriminating against pregnant police officers, against female officers generally, and other wrongful discharge claims.
  • Defense of a college accused of failing to provide accommodation for Muslim prayers during working hours; of discriminating on the basis of age, race, gender, and disability; of defamation relating to a former athletic coach; and of retaliating against former or current employees.
  • Defense of Japanese and U.S. manufacturers against claims addressing classifications of exempt and non-exempt workers.
  • Defense of construction contractors against claims of same-sex harassment, and class actions brought by the EEOC alleging systematic discrimination against Hispanic workers.
  • Defense of financial institutions accused of age and disability discrimination.
