Jonathan’s practice encompasses a variety of civil litigation matters with a primary focus on insurance, subrogation and commercial-related litigation. More specifically, he defends commercial, premises liability, products liability, employment discrimination and commercial transportation cases in both federal and state courts.
Jonathan actively represents insurance carriers, certified self-insureds, third party administrators and employers in matters involving indemnity benefits and medical benefits liability before the Texas Division of Workers’ Compensation. Using his experience from both sides of the docket, he represents the interests of insurance carriers and their insureds through all aspects of the Texas workers’ compensation process including benefit review conferences, contested case hearings, appeals and medical disputes before the State Office of Administrative Hearings.
- Obtained significant nonsuit through non-party discovery on behalf of international fire protection and suppression company named in a water damages lawsuit due to an alleged improper and faulty installation of the sprinkler system piping; aggressive discovery revealed acts of misconduct by a commercial property owner that had been documented by a non-party
- Successfully represented the claimant in a fully denied claim involving a motor vehicle accident by proving a special mission exception to overcome the carrier’s affirmative defense
- Obtained a favorable finding for the claimant in a fully denied claim involving an assault in which the carrier failed to prove a personal animosity exception
