Evan concentrates his defense practice on labor law, specifically New York Labor Law sections 200, 241(6) and 240. He also handles cases involving construction liability, premises liability, property damage and personal injury matters. In addition to defending insurance litigation, Evan’s representative experience includes medical institutions, motor vehicle and interstate trucking accidents, and funeral home operators on the loss of sepulcher claims.

As an experienced trial lawyer, Evan handles cases from inception to jury verdict and has represented clients during mediation and arbitration throughout the State of New York. Prior to joining Litchfield Cavo LLP, Evan was trial counsel at prominent insurance defense law firms in New York City and Westchester, New York. He began his legal career as an assistant district attorney (ADA) in the Westchester County District Attorney’s Office. As an ADA, Evan prosecuted individuals for crimes of domestic violence, as well as child, elder and animal abuse.

Practices

  • Obtained summary judgment and dismissal of all claims and cross-claims against our construction company owner client after Plaintiff walked into a scaffold on a construction site where our client had previously worked, and sustained injuries; the Court agreed with our attorneys’ arguments and granted their motion on behalf of our client.
  • Obtained dismissal for owner/landlord after Plaintiff was delivering soda to Co-defendant/tenant’s restaurant and fell through an unguarded basement opening and suffered significant injuries and filed suit; the Court found that our client was an out-of-possession landlord who had no notice of a dangerous condition, and that Co-defendant was solely negligent.
