California Partner Achieves Favorable Result in Landlord-Tenant Suit
Los Angeles-area Partner Daniel Ip recently achieved a favorable result on behalf of our landlord client in a Riverside Superior Court case involving alleged housing law violations.
Plaintiff executed her lease with our landlord client in 2012. In Plaintiff’s Complaint, she claimed she had habitability issues with her leased property including a rodent infestation, plumbing failures that also included a non-operable bathroom, electrical problems, damaged flooring, damaged and unsafe heating, ventilation and air conditioning (HVAC) components and general disrepair. Plaintiff claimed she notified our client of the worsening state of the property and alleged that our client either delayed responding, denied responsibility, or performed incomplete and ineffective repairs. Subsequently, Plaintiff filed suit against our client asserting claims for breach of the lease agreement and breach of the warranty of habitability, among other allegations.
Prior to trial, our defense attorney Daniel Ip prepared and filed motions excluding certain medical records presented by Plaintiff and additional claims asserted on behalf of Plaintiff’s non-party son involving his alleged health issues.
In April 2026, the Superior Court agreed and granted our defense motions to exclude Plaintiff’s medical records and denied claims of physical injuries from alleged exposure to environmental toxins created by uninhabitable conditions, delivering a favorable ruling on behalf of our client. This matter was resolved through settlement immediately prior to trial.
