Illinois Attorney Summarizes Employer and Employee Coverage Under the FFCRA
Chicago attorney Sean F. Darke has authored a new Litchfield Alert, “Department of Labor Clarifies Employers and Employees Coverage Under The FFCRA,” an update to the Families First Coronavirus Response Act (“FFCRA”).
Sean’s summary of the FFCRA coverage update is in accordance with the current U.S. Department of Labor guidelines to help businesses better understand and navigate whether or not they are covered under the Emergency Paid Sick Leave Act (“EPSLA”) and the Emergency Family and Medical Leave Expansion Act (“EFMLEA”).
Sean’s current Alert explains the criteria used to identify an “employer” and how the fewer than 500 employee threshold is determined week-to-week. He includes information about how employers should restore their employees to the same or equivalent position under FFCRA. Sean also addresses whether emergency responders, military, health care providers, education institutions, religious and nonprofit organizations are covered under FFCRA.
