Chicago Partner Quoted in Duke Law School Journal
In the recent issue of the Duke University School of Law Judicature journal, Litchfield Cavo Partner Daniel G. Litchfield commented on the use of jury questionnaires as a predicate to voir dire. The featured segment, Asking All the Right Questions, was authored by U.S. District Court Judge Stephen R. Bough of the Western District of Missouri and Ms. Kaitlin Minkler. Litchfield commented about the questionnaire’s role in the trial of a case that Judge Bough and Ms. Minkler accurately characterize as a groundbreaking matter. The case was the first jury trial addressing coverage for lost business income resulting from the Coronavirus pandemic.
In “Benefits of Juror Questionnaires and Attorney-Conducted Voir Dire,” Dan notes one particularly unique challenge in the case: jurors being asked to weigh in on issues they may have experienced themselves. In his words, it was “like trying liability for an intersection collision while the collision was happening.” This reflects one of the groundbreaking features of the trial.
