Atlanta Partner Brenton S. Bean authored a featured article on the Defense Research Institute’s (DRI)’s JD Supra profile. Brent’s article, “Curation Litigation: Social Networks’ Right to Be Unsociable” was originally published in DRI’s For The Defense (FTD) magazine in the July & August 2024 issue, and will be re-published in several JD Supra newsletters.
In Brent’s article, he discusses the landscape of free speech rights in relation to content-based restrictions, compelled speech and viewpoint discrimination. He shares the fundamental arguments made in two United States Supreme Court cases involving state laws that seek to regulate a social media platform’s right to moderate or select the content that appears on its website. Brent states, “The rulings on these two cases will likely define how free speech is safeguarded or restricted in the electronic town square.” Brent’s presented cases were decided on July 1, and the Supreme Court remanded both cases.
In his article, Brent concludes, “The manner in which the Court decides these cases will have a profound effect not only on what can or cannot be said on social media platforms, but also how the government can tell private media entities what to say or do and not say or do.”
Brent focuses his law practice on defending employers in state and federal courts nationwide.
