Illinois Attorney Obtains Dismissal in Americans with Disabilities Act Class Action Suit
Chicago Attorney Brian Hoppe recently prevailed on behalf of our corporate wellness client in a federal civil rights class action lawsuit based on alleged non-compliance with the Americans with Disabilities Act (ADA), heard in the United States District Court for the Northern District of Illinois.
In their suit, Plaintiff claimed our client’s website was not compliant with ADA website accessibility guidelines, and subsequently filed a class action complaint against our client.
Our defense attorney Brian Hoppe established that our client’s website was compliant with WCAG 2.1, Level AA and Section 508 of the Rehabilitation Act (29 U.S.C. § 794d), resulting in Plaintiff dismissing all claims against our client with prejudice.
In September 2025, the Court granted the dismissal with prejudice.
Brian Hoppe has experience defending claims filed under the Americans with Disabilities Act, and claims arising from other constitutional violations under 42 U.S.C. §1983.
