Missouri Partner Granted Dismissal in Business Application Denial Cases
Kansas City Partner Michael Kopit was recently granted a Motion to Dismiss on behalf of our agricultural business application evaluation client in the United States District Court for the Western District of Missouri in four separate cases involving the denial of business applications submitted by Plaintiffs.
Our client was retained by the State of Missouri to review applications submitted by entities seeking to obtain a business license to grow and sell agricultural products in Missouri. Plaintiffs submitted their separate applications to the State of Missouri with the intent to obtain licensure. Following the review process, Plaintiffs did not receive a license and each filed individual suits against our client for its role in evaluating their application.
The United States District Court for the Western District of Missouri held that each Plaintiff failed to state a claim against our business application evaluation client, and dismissed all four claims.
Michael defends clients against general liability matters including commercial liability, personal injury, motor vehicle and premises liability claims.
