NY Attorneys Prevail on Motion to Dismiss in New York City Asbestos Litigation (NYCAL)

Litchfield Cavo attorneys Andrew Sapon, Michael R. L’Homme and Sasha J. Ensslin prevailed on a motion to dismiss in the Supreme Court of the State of New York, New York County on a matter involving allegations that the use of cosmetic talcum powder allegedly contaminated with asbestos caused plaintiff’s mesothelioma.

The Litchfield Cavo attorneys’ motion to dismiss the case were granted based upon a finding that the Court lacked personal jurisdiction over our client, an international mining corporation. Our attorneys successfully argued that our client was not liable as successor to suppliers of the talc used in the powder and that jurisdiction was improper under New York’s Long-Arm Statute and constitutional Due Process. This decision has considerable impact as the client was defending numerous lawsuits in the State of New York.
