NYC Attorney Achieves Motion to Dismiss in New York Supreme Court
Litchfield Cavo attorney Dana M. Ricci prevailed on a motion to dismiss in the Supreme Court of the State of New York, Onondaga County on a matter involving the use of cosmetic talcum powder that allegedly was contaminated with asbestos caused plaintiff’s mesothelioma.
Dana’s motion to dismiss the case was granted by Judge DelConte based upon a finding that the Court lacked personal jurisdiction over our client, an international mineral corporation. Our attorneys successfully argued that jurisdiction was improper under New York’s Long-Arm Statute and constitutional Due Process.
