Illinois Partner Peter Kim Obtains Dismissal for Foreign Government Client

Chicago partner, Peter C. Kim, recently obtained a complete dismissal with prejudice on behalf of our client, a foreign government agency. Our attorney responded to the lawsuit claiming the theory of respondeat superior, negligent hiring, training and supervision of an employee. The plaintiff sued our client when one of its employees was involved in an auto accident and sought over $1 million from alleged permanent injuries.

Peter motioned for summary judgment arguing the foreign governmental agency was immune from the lawsuit under the Foreign Sovereign Immunity Act, and that the plaintiff failed to produce evidence demonstrating one of the Act’s exceptions applied to nullify the immunity defense.

Rather than respond to our motion, the plaintiff dismissed the foreign government from the lawsuit with prejudice and continued with litigation against the remaining defendants.
