Illinois Partners Win Dismissal in Commercial Property Asbestos Case
Chicago partners Joseph P. Sullivan and Kevin A. Titus recently obtained dismissal of a client that was named a defendant in an asbestos lawsuit pending in DeKalb County, Illinois. The case involved a claim of exposure at a commercial property owned by a partnership. Our client became a partner in the defendant partnership more than ten years after the plaintiff’s last alleged exposure to asbestos.
Joe and Kevin successfully argued that, under the Illinois Partnership Act, no liability can attach to a partner for partnership conduct that occurs before that partner joins the partnership, even though the alleged injury may accrue decades later.
