Illinois Attorneys Obtain Summary Judgment in Medical Negligence Case
Chicago Partner James D. Sloan and Attorney Sarah V. Bourdet obtained summary judgment on behalf of our client, a surgical center, in the Circuit Court of Cook County.
Plaintiff was involved in an automobile accident and injured one of her ankles, tearing ligaments and fracturing her talus. The co-defendant orthopedic surgeon performed a minimally-invasive subchondroplasty procedure, which involved injecting a bone substitute material into the talus to regenerate bone. Following the subchondroplasty, Plaintiff alleged that the procedure should not have been performed and that the co-defendant, an alleged agent of our client, negligently performed the surgery.
Our attorneys, Jim and Sarah, filed a motion for summary judgment on behalf of the surgicenter, arguing that the surgeon was neither an actual nor an apparent agent of the surgicenter. The court agreed with our positions and entered summary judgment in favor of our client.
Jim focuses his practice on defending medical professional liability claims.
