Illinois Attorneys Prevail in Cook County Premises Liability Case
Chicago Partner Lawrence R. Stolberg and Attorney Stephen M. Cady recently secured summary judgment in favor of our medical facility client at the Circuit Court of Cook County.
Plaintiff, an occupational therapist that was employed by a third-party organization and worked on-site at our client’s medical facility, claimed she slipped on water at our client’s facility and fell down 12-13 stairs. Plaintiff experienced non-surgical fractures to her ankle and wrist, soft tissue injuries to her back and later complained of shoulder pain for which surgery was recommended. Due to her injuries, Plaintiff was unable to work for more than one year and claimed loss of income from three jobs, as well as damages for loss of normal life, medical expenses, and pain and suffering.
In the motion for summary judgment, Larry and Steve argued that our client did not have actual or constructive notice regarding the presence of water on the stairs of the facility and argued that there was no evidence that established how the water allegedly accumulated on the stairs. In November 2022, the Court agreed with our attorneys and the motion for summary judgment was granted in favor of our client, and a memorandum order followed.
