Kenneth is a lifelong resident of West Virginia and represents clients in both West Virginia and Pennsylvania state and federal courts. He focuses his practice primarily on the defense of government entities and their employees including boards of education, city and county law enforcement, transportation departments, utility boards, cities and towns, and municipalities. Kenneth defends claims involving alleged violations of the U.S. Constitution, discrimination under the West Virginia Human Rights Act and wage disputes under the West Virginia Wage Payment and Collection Act. He also handles employment and wrongful discharge claims, workplace injuries and premises liability matters. Further, Kenneth has represented clients in property damage cases including water and sewer damage, as well as radiation exposure claims.

Kenneth’s corporate and individual defense has provided him the opportunity to handle a wide array of matters including but not limited to motor vehicle accidents, trucking accidents, property damage claims involving landslides and wrongful death claims, as well as personal injury matters involving slips, trips and falls. He also represents clients in claims concerning animal bites, chemical exposure, construction defects, claims brought under the West Virginia Deliberate Intent Statute and contract disputes.

  • Prevailed on summary judgment for municipality in numerous state and federal court actions by property owners alleging unlawful taking of their property pursuant to the 4th, 5th, and 14th Amendments of the U.S. Constitution. Of the matters appealed, prevailed on appeal before the Fourth Circuit Court of Appeals and WV Supreme Court.
  • Prevailed on summary judgment for police department in an alleged excessive force case and prevailed on appeal before the Sixth Circuit Court of Appeals.
  • Prevailed in obtaining summary judgment for various local and county law enforcement agencies against claims asserted under the U.S. Constitution and the West Virginia Constitution.
  • Prevailed in defeating a request for a preliminary injunction against a government employer.
  • Prevailed in obtaining summary judgment for county board of education on premises liability claim, and also prevailed on appeal before the Supreme Court of Appeals of West Virginia.
  • Defended clients at trial in civil action involving landslide and multi-million dollar property damage claim.
  • Defended client at trial in civil action involving a wrongful death following an altercation outside of a local establishment.
