Tobey focuses on commercial and personal defense litigation in state, federal and appellate courts. His law practice includes defending medical and non-medical professional liability, D&O liability and homeowners associations. He also handles premises liability and construction defect, products liability and wrongful death claims, as well as environmental, toxic tort, asbestos litigation and fire subrogation. Tobey has additional experience handling insurance coverage matters.

Tobey has experience with municipal court matters, real estate closings, wills and estates, plaintiff’s personal injury and personal injury protection. He has represented nonprofit entities in specialized cases, such as preservation of abandoned railroad tracks and a private art collection. Tobey also has experience handling employment discrimination and workers’ compensation claims.

Tobey regularly participates in alternative dispute resolution and has acted as a mediator in state court matters, and has appeared before state and federal administrative agencies. He has acted as solicitor to several New Jersey municipalities, and he has served as a judicial law clerk to the Honorable William L. Forester, Superior Court of New Jersey, Cumberland County as well as a Junior Trustee for the Cumberland County Bar Association.

Practices

  • Obtained summary judgment for our pump manufacturer client following a suit by Plaintiff who developed lung cancer, alleging he was exposed to asbestos while working at his former employer’s refinery that used our client’s products; Middlesex County judge agreed with our attorneys’ arguments that our client’s products did not contain asbestos components, and therefore did not contribute to Plaintiff’s illness.
  • Obtained dismissal on behalf of a fastener manufacturer client wherein Plaintiff filed suit, ultimately naming six Defendants, that either sold or manufactured items that were part of the flip-line kit; the Appellate Court agreed that Plaintiff’s claims required expert opinion and concluded that the lower Court was acting within its discretion to exclude the expert, and also determined that the District Court had properly granted summary judgment on the New Jersey Products Liability Act claims.
  • Obtained summary judgment for a fastener supply company client following Plaintiff’s claims that his bolt broke from a device that secured him to the roof and who later sued multiple defendants; successfully challenged the Plaintiff’s expert witness opinion pursuant to Daubert and obtained summary judgment pursuant the New Jersey Products Liability Act, and that liability could not be established without an expert opinion.
