Litchfield Cavo Attorneys Prevail on Summary Judgment in Slip and Fall Suit
Litchfield Cavo LLP Partner Michael Hahn, Partner Mark DelRosario and Attorney Jacob Stephens prevailed in the Gwinnett County Superior Court following a slip and fall incident that took place in our client’s restaurant.
On the date of the incident, Plaintiff was visiting our client’s restaurant and alleged that she slipped and fell while descending a staircase. Plaintiff reported injuries to her neck and back, and also stated that she suffered hip and shoulder pain, accompanied by ongoing headaches. Immediately following the incident, and again during a medical evaluation the following day, Plaintiff asserted that the floor had been waxed and was inherently slippery.
At the hearing, our Litchfield Cavo defense attorneys argued that Plaintiff failed to present any witnesses to the alleged slip and fall incident, and offered no evidence that our client’s floor had been waxed. Thus, Plaintiff failed to present evidence in support of her claims.
In August 2025, the Gwinnett County Superior Court agreed with our defense attorneys’ arguments and granted our Motion for Summary Judgment in favor of our client.
