Houston Attorneys Win Motion of Summary Judgment in Defense of Homeowners’ Association
October 1, 2015
On September 30, 2015, Federal Judge Kenneth Hoyt of the US Southern District of Texas granted our home owner association client’s motion for final summary judgment.
Plaintiffs alleged that our client and its co-defendants wrongfully foreclosed their property and violated various state and federal consumer protection statutes. Plaintiffs were seeking to recover damages for the alleged loss of value to their property and mental anguish.
Our association client was represented by Litchfield Cavo’s Houston attorneys Laura Beckman Hedge and Armando Chiu. Judge Hoyt also granted similar motions filed by co-defendants but denied plaintiffs’ cross-motions. A final take nothing judgment was entered on the same day.
