Louisiana Attorney Prevails in Casino Premises Liability Suit

Mandeville Attorney Murphy Burke recently prevailed for our casino client in a 14th Judicial District Court premises liability case.

In his suit, a guest of our client’s casino claimed he was riding down an escalator on our client’s property when his pant leg got caught on a loose access panel, causing his legs to be forced into a “split” position. Following the incident, Plaintiff claimed significant injuries to his legs, feet and groin, and filed suit against our client.

In his deposition, Plaintiff testified that he did not see the access panel that allegedly caused the incident. Additionally, a witness to the alleged incident testified that she also did not see what caused the incident. Subsequently, Litchfield Cavo Attorney Murphy Burke filed a Motion for Summary Judgment based on lack of proof of a defect on our client’s premises that presented an unreasonable risk of harm. Our defense attorney also contended that our client did not have actual or constructive knowledge of a dangerous condition on their casino premises.

In August 2025, the Court granted our Motion for Summary Judgment, ruling in favor of our client.
