Massachusetts Attorneys Prevail on Summary Judgment in Personal Injury Suit
Boston-area Partner Nora R. Adukonis and Attorney Stephen J. LaMonica prevailed on a Motion for Summary Judgment, granted in the Plymouth County Superior Court for a personal injury matter.
Plaintiff, a machinist and employee of a wholly-owned subsidiary of our manufacturing company client, attempted to adjust the grinding wheel on a large piece of machinery and sustained a severe disfiguring, and an allegedly disabling, degloving injury to her hand. Although Plaintiff sought and obtained workers’ compensation benefits from her direct employer, she filed suit against our client alleging negligence, including failure to supervise and failure to train.
In their summary judgment motion, Litchfield Cavo attorneys Nora Adukonis and Stephen LaMonica argued that our client had no duty to protect Plaintiff. In March 2025, Superior Court Justice Gregg Pasquale agreed with our attorneys’ arguments, holding that “the plaintiff had no reasonable likelihood of proving that defendant, a parent company, owed her a duty of care,” and ruled in favor of our client.
Nora primarily practices in the areas of employment liability, product liability, premises liability and construction. She defends clients in actions alleging injuries or property damage from defective products, fires, floods or chemical exposure. Nora has also defended municipalities and other public entities in cases ranging from wrongful discharge to defamation.
Stephen concentrates his civil litigation practice in the areas of general liability and construction liability. He has experience representing businesses and individuals in premises liability issues including slip and fall matters, as well as construction defect, construction accident and motor vehicle cases.
