Texas Attorneys Prevail in Hotel Slip and Fall Case

Houston Partner Matthew D. Walker and Attorney Beasia C. Dozier obtained a favorable outcome in the 419th Civil District Court in Travis County, Texas, on behalf of our hotel management company client following a slip and fall incident on our client’s property.

In September 2022, Plaintiff, a hotel visitor, was walking the perimeter of our client’s hotel parking lot and fell into an exposed three-foot planter. Following the incident, Plaintiff claimed to have sustained a broken ankle, as well as injuries to their shoulder, back and knees. Plaintiff testified that due to their injuries, they now walk with a limp and have limited ability to complete all of their job functions.

At trial, our defense attorneys, Matt Walker and Beasia Dozier, refuted Plaintiff’s claims for future medical expenses, and also showed evidence that Plaintiff’s claims for future disability and pain and suffering were minimal. Our defense also established that Plaintiff’s broken ankle healed without any signs of traumatic arthritis. Additionally, Matt and Beasia challenged Plaintiff’s life-care planner’s testimony and showed that there was no medical basis for Plaintiff to receive any future medical care.

In August 2024, the jury agreed with our defense’s arguments and returned a verdict on compensatory damages suggested by the defense.
