Texas Partner Granted Summary Judgment in Negligent Security Suit

Houston Partner Scott Scheinthal successfully obtained summary judgment in favor of our property client and related entities in the United States District Court for the Southern District of Texas, Houston Division in a case of negligent security following a lawsuit filed by Plaintiff after a tragic incident occurred on our client’s premises.

In July 2021, Plaintiff, a guest of a unit tenant, was involved in a violent altercation and subsequently suffered fatal injuries. Following the tragic event, a family member of the decedent filed suit against our clients.

The Court found that there was no evidence to support Plaintiff’s claims and held that “the record does not raise a factual issue as whether the defendants owed and breached a duty to defend the plaintiff from third party gun violence,” ruling in favor of our client.
