Three Midwest States Curb and Limit Coverage

Chicago partner Andrew G. Witik summarized recent decisions from the Supreme Courts of Kentucky, Ohio and Wisconsin that discuss limiting coverage for significant property damage resulting from varied events. These judicial opinions issued between August and October 2018 address multi-million dollar damages caused from improper mining of coal from the wrong property, faulty workmanship of subcontractors in the construction of new university buildings and a destructive three day wild fire over thousands of acres. In each case, the state’s supreme court addressed the key policy term “occurrence” and its interpretation.
