Practices
- Obtained dismissal for nonprofit facility wherein Plaintiff relied on the New York Child Victims Act (CVA) provision to revive an action after the statute of limitation passed, and then failed to file before the expiration, arguing that COVID-19 Executive Orders tolled the suit; the Court held that the statute of limitation was not tolled.
- Prevailed on behalf of condominium Homeowners Association wherein a unit owner filed a summons without a Complaint, alleging fraud; our attorneys submitted a motion to dismiss and the Court agreed that Plaintiff’s failure to file an affidavit or a timely Complaint justified dismissing the action in favor of our client.
