Practices

  • Granted Motion to Dismiss in cases wherein four separate entities submitted applications to the State of Missouri to obtain licensure to grow and sell agricultural products, and all four entities did not receive a license and each filed suit against our business application evaluation client for its role in evaluating their applications; the Court held that each Plaintiff failed to state a claim against our client and dismissed all four claims.
  • Obtained Motion to Dismiss for municipal public works client after Plaintiff’s commercial property flooded with water and alleged that our client was negligent in supervising and inspecting pipeline work performed near Plaintiff’s property; the Court agreed with our Defense that our client had sovereign immunity, and that Plaintiff failed to plead a waiver of the sovereign immunity or state any facts indicating that the limited exceptions were applicable, and ruled in favor of our client.
