Joe is a dedicated, thorough and attentive attorney that drives favorable results for his clients. He concentrates his practice on insurance defense, general litigation and general negligence. Joe also handles professional, premises and motor vehicle liability matters, as well as employment liability claims including wage and hour disputes. He provides counsel to co-op and condominium association board members. Joe handles all aspects of the litigation process—from the early stages of drafting pleadings and motion practice, to discovery and depositions. He has additional experience preparing cases for trials and appeals.

Prior to joining Litchfield Cavo LLP, Joe was a trial attorney at a boutique law firm in New York City. During that time, he handled commercial litigation claims, real property matters and business disputes.

While earning his Juris Doctorate at New York Law School, Joe was accepted into the school’s accelerated two-year honors program for the inaugural year. The program focuses on key areas of growth for New York City’s economy, and provides students the opportunity to complete a traditional curriculum within two years. Students are invited to apply for the program based on their academic success.

Practices

  • Obtained dismissal for nonprofit facility wherein Plaintiff relied on the New York Child Victims Act (CVA) provision to revive an action after the statute of limitation passed, and then failed to file before the expiration, arguing that COVID-19 Executive Orders tolled the suit; the Court held that the statute of limitation was not tolled.
  • Prevailed on behalf of condominium Homeowners Association wherein a unit owner filed a summons without a Complaint, alleging fraud; our attorneys submitted a motion to dismiss and the Court agreed that Plaintiff’s failure to file an affidavit or a timely Complaint justified dismissing the action in favor of our client.
  • Prevailed in the New York State Division of Human Rights (NYSDHR) on behalf of our large medical facility client against a former certified nursing assistant (CNA) employee who filed a complaint alleging discrimination and retaliation based on her race and national origin following her termination; the order was issued in our client’s favor following an NYSDHR investigation finding no probable cause and the claimant failing to identify similarly situated employees being treated more favorably.
