Texas Attorneys Obtain Dismissal in Trucking Collision Matter
Dallas-Fort Worth Partner Matthew T. McLain and Attorney Kaitlin E. Palmarozzi prevailed in the 111th Judicial District Court of Texas in Laredo, Texas on behalf of our trucking company client and its box truck driver in a case that involved a trucking collision that led to a fatality. Houston Partner Jennifer R. Grillo also contributed to this outcome by successfully arguing an important motion on behalf of our client.
In August 2020, our client’s box truck had become disabled on the side of a Texas interstate. Our client’s driver exited the box truck and waited for a towing company to retrieve the truck. While the tow truck driver was loading our client’s box truck onto the tow truck’s flatbed, an independent third-party tractor-trailer operator traveling north on the interstate veered out of his lane of travel and struck the back corner of the tow truck, fatally injuring the tow truck driver and injuring our client’s driver. Subsequently, the estate of the deceased tow truck driver filed suit against our client and multiple other defendants.
Our attorneys argued that the independent third party who was operating the tractor-trailer was solely at fault for the accident and that our client had not violated any legal duty. In May 2024, the 111th Judicial District Court of Texas granted complete dismissal of all claims against our trucking company client and its driver.
