Dana concentrates her practice on insurance coverage, products liability, toxic tort and construction litigation and handles matters involving premises liability, site accidents and asbestos litigation. Her experience also includes trucking and motor vehicle litigation and claims of negligent security and breach of contract.
In addition to her defense litigation experience, Dana handles an array of civil litigation and insurance coverage cases and counsels insurance clients on policy drafting as well providing coverage opinions.
- Successfully argued a products liability case before the Second Department wherein the Court affirmed dismissal of the plaintiff’s action based upon expert evidence that the client’s product was not the proximate cause of the explosion. See Kammerzell v. Clean Burn, Inc., 165 A.D.3d 769 (2d Dept. 2018)
- Successfully argued an insurance coverage dispute before the First Department of the New York Supreme Court, Appellate Division, wherein our client did not owe coverage to the plaintiffs attempting to be named as additional insured on our client’s Commercial General Liability policy. Turner Constr. Co. v. Endurance Am. Specialty Ins. Co., No. 3025, 2018 WL 2049386 (1st Dept. May 3, 2018)
- Successfully argued an insurance coverage dispute wherein our client did not owe additional insured coverage to plaintiffs where it properly disclaimed coverage based upon untimely notice. See Pavarini McGovern, LLC v. Geiger Constr. Co., Inc., 58 Misc. 3d 1203(A) (N.Y. Sup. Ct. 2017)
