Dana concentrates her practice on insurance coverage litigation, construction site accidents, premises liability, trucking and motor vehicle litigation, toxic tort claims and asbestos litigation. She also has experience handling claims for negligent security, breach of contract and products liability. In addition to handling a diverse assortment of civil litigation and insurance coverage cases, Dana provides coverage opinions and policy-drafting advice to insurers.
- Successfully argued a products liability case before the Second Department wherein the Court affirmed dismissal of the plaintiff’s action based upon expert evidence that the client’s product was not the proximate cause of the explosion. See Kammerzell v. Clean Burn, Inc., 165 A.D.3d 769 (2d Dept. 2018)
- Successfully argued an insurance coverage dispute before the First Department of the New York Supreme Court, Appellate Division, wherein our client did not owe coverage to the plaintiffs attempting to be named as additional insured on our client’s Commercial General Liability policy. - Successfully argued an insurance coverage dispute wherein our client did not owe additional insured coverage to plaintiffs where it properly disclaimed coverage based upon untimely notice. See Pavarini McGovern, LLC v. Geiger Constr. Co., Inc., 58 Misc. 3d 1203(A) (N.Y. Sup. Ct. 2017)
