Nathan represents individuals, small businesses and large global corporations in complex litigation involving high-stakes commercial disputes, construction and real estate litigation, labor and employment matters, and trade secret litigation in both state and federal courts. He focuses his employment law practice on corporate clients in litigation involving Title VII, the American with Disabilities Act, Fair Labor Standards Act, Age Discrimination in Employment Act, Family and Medical Leave Act, Employee Retirement Income Security Act, Chapter 21 of the Texas Labor Code, and the Texas Whistleblower Act, as well as restrictive covenants/non-compete agreement litigation.

Nathan’s commercial litigation practice includes representing corporate entities including corporate officers and directors involved in business and commercial-related disputes such as: breach of contract, breach of fiduciary duty, breach of warranty; non-compete, non-solicitation and trade secret disputes; defamation and/or business disparagement; and, tortious interference with contract, fraud, deceptive trade practices, products liability and other business-related torts.

Nathan has additional experience handling personal injury defense matters including Dram Shop Act liability and professional liability defense.

Practices

  • Obtained 12(b)(6) dismissal and fraudulent joinder finding in federal court in the Northern District of Texas in defense of clients in COVID-19 related business interruption insurance coverage dispute.
  • Obtained summary judgment in Harris County District Court in Houston, Texas, in defense of major aluminum and other lightweight metals manufacturer against employment discrimination claims.
  • Obtained defense verdict in federal court in the Northern District of Texas against Title VII and ADEA claims of employment discrimination.
  • Obtained Rule 12(b)(6) dismissal with prejudice in federal court in the Southern District of Texas in defense of large Indian media and entertainment company against claims for fraud, business disparagement and breach of contract.
  • Second chair in three-day bench trial at federal court in Dallas, Texas, and obtained an injunction and declaratory judgment that our client’s system of electing at-large members to the City Council violated Section 2 of the Voting Rights Act; favorably awarded nearly $400,000 in attorneys’ fees and court costs.
  • Second chair in two-week jury trial in Harris County District Court in Houston, Texas, and obtained verdict in support of breach of contract and fraud claims for insurance restoration construction client against the owner of seven commercial properties in the Houston metropolitan area.
  • Successfully defended motion to dismiss for lack of personal jurisdiction in Oklahoma County District Court on behalf of Texas law firm against claims of legal malpractice based on underlying representation of Oklahoma entity in bankruptcy litigation.
  • Member of trial team in the High Court of Justice of England and Wales, Queen’s Bench Division, and represented Fortune 500 company client in breach of contract dispute wherein client allegedly failed to bring to market a rapid screening test product for Methicillin-resistant Staphylococcus aureus (MRSA).
