California Attorneys Obtain Defense Verdict in Vehicle–Bicycle Collision Trial
Los Angeles-area Partner Ashley R. Morris and Of Counsel David T. Ching obtained a defense verdict on behalf of our client following a month-long trial arising from a vehicle–bicycle collision in the Santa Monica Courthouse.
In March of 2022, Plaintiff was riding a bicycle east on Melrose Ave. in Hollywood, California while our client was maneuvering their vehicle into a parking space in front of the Plaintiff rider. Plaintiff alleged that our client suddenly “darted” their vehicle into his path of travel, causing Plaintiff and our client’s vehicle to collide. As a result of the collision, Plaintiff allegedly sustained multiple orthopedic injuries and a claimed traumatic brain injury. Plaintiff further alleged ongoing psychological harm, including depression, anxiety and other emotional distress.
During the trial, Litchfield Cavo Partner Ashley Morris and Of Counsel David Ching demonstrated that the collision was avoidable and that Plaintiff was positioned behind our client’s vehicle at all relevant times.
The jury agreed with our arguments and returned a complete defense verdict, finding our client not negligent.
