Phil focuses his defense litigation practice on construction negligence, personal injury, toxic tort and wrongful death claims. He also concentrates on corporate defense, professional liability and medical malpractice. Representative matters include defective products, construction defects, motor vehicle accidents and other casualties. Phil defends insureds, contractors and tradesmen as well as manufacturers and distributors in actions alleging injuries or property damage. Phil litigates throughout Illinois, Indiana and Michigan in state and federal courts.

While attending the Chicago Kent College of Law in Chicago, Illinois, Phil organized and supervised the Self Help Web Center desk at the Daley Center that serves as a resource for guiding pro se litigants through the legal process. He also volunteered with World Relief, a not-for-profit organization providing immigration services to those in need in the greater Chicagoland area.

Practices

  • Decision affirmed on appeal for our substance testing laboratory client against RICO claims brought by users of our client’s substance testing kits who received unfavorable results; the Seventh Circuit upheld the dismissal by the Northern District of Illinois and ruled in favor of our client.
  • Obtained favorable result for a waste disposal company after its employee struck Plaintiff while operating a garbage truck, causing her to sustain injuries, and the Circuit Court reduced the award based on Plaintiff’s comparative fault, yielding a judgment below the undisputed medical bills offered into evidence.
  • Obtained favorable verdict for a credit union client following oral arguments in a Lake County Superior Court bench trial wherein Plaintiff alleged race and age discrimination and other unfair business practices.
  • Successfully defended an insurance company and a credit union client at trial against Plaintiff’s allegations of fraud, conversion and violations of banking regulations relating to an insurance policy application and subsequent automatic payments.
  • Obtained summary judgment for a development company in a construction defect case by successfully arguing that an alleged oral contract was too vague to be enforceable under Illinois law.
  • Obtained favorable arbitration result for insured’s driver who rear-ended Plaintiff’s vehicle and who initially claimed no injuries but later went to an emergency room with three friends who were not in the vehicle at the time of the collision, also claiming injury; our Defense presented evidence of fraud and the arbitrator awarded Plaintiffs less than 20 percent of Plaintiffs’ claimed medical bills.
  • Successfully obtained the dismissal of an asbestos product manufacturing client from all pending Indiana state court matters based on a lack of personal jurisdiction.
  • Obtained summary judgment for a manufacturer of asbestos-containing component parts in Indiana state court, satisfying the state’s strict standard that required the defendant to
  • affirmatively negate the plaintiff’s claims.”
  • Obtained summary judgment in Indiana state court for a construction manager in a construction defect case by successfully arguing that the manager owed no duty of care to the patron after premises damage occurred following construction.
  • Obtained summary judgment for a professional sports team and its league in a premises liability action, successfully arguing that a third party had sole responsibility for maintaining the premises.
