Our Business Litigation Defense Record
- Defended construction company’s Officers in a $1.3 million breach of contract, fraud and negligent misrepresentation action involving the sale of its business; after a three-and-a-half-week trial the jury returned a defense verdict.
- Defended an Officer of a finance company in a $1.2 million breach of contract, fraud and negligent misrepresentation case involving a business investment; after a one-week trial the jury returned a defense verdict.
- Obtained summary judgment for a consulting firm client accused of committing or aiding and abetting fraud during the sale of two commercial buildings; the Court granted our defense motion and later awarded costs and attorneys’ fees.
- Prosecuted a breach of fiduciary duty claim against a major accounting firm arising from the simultaneous merger of more than 30 companies.
- Obtained dismissal for an accounting firm Principal against racketeering, fraud and trade secret violations, upheld on appeal before the United States Court of Appeals for the Third Circuit, and petition for rehearing en banc; the Appellate Court panel of judges found that Plaintiffs failed to support their federal RICO Act, the Computer Fraud and Abuse Act and the Defend Trade Secrets Act claims, and affirmed the dismissal denying Plaintiffs’ petition for rehearing.
- Defended a law firm in fraud and legal malpractice claims involving the sale of a multi-million dollar apartment complex; after a two week trial, the jury returned a defense verdict.
- Successfully defended a credit union on appeal against claims of breach of the UCC, negligence, breach of warranties and violation of federal statutory law.
- Successfully briefed and argued a complex contract action before the Fifth District Appellate Court on behalf of financial services company that purchased an annuity from a structured settlement beneficiary in exchange for lump sum payments; the Appellate Court reversed the lower court and ruled in favor of our client.
